Kitchen Fire Questions....?

I am from Ky, We had a kitchen fire in Nov. we was cooking but our pan was not on fire until we tossed water on the stove then it like blew up and my pan did catch then it got pretty intense and seconds seemed like minutes. we figured we would never get it under controll as long as the pan was on fire so my husband grabbed it and through it outside. "Got burned bad" any ways since we lived in there the stove didnt work had problems it just got fixed, the fire burned 4 cabinets the knobs in the middle of the stove was burned as well, hubby couldnt work due to burn we couldnt pay the rent until middle of Dec L/L wouldnt wait told us to leave so we did. now I am being Sued by Ins Company they gave him a whole new kitchen.. said it was Grease fire. even tho it was Electical how can I go about Proving my case? I dont know what to do I have more information but not enough room to type everything.. please anyone help me...what do I do?

  1. your case-it sounded like the fire was caused by a cooking fire. I do not understand how you can fight the insurance company. You were there. Your husband was there. You are responsible for the smoke and fire damage.
  2. First of all, if they're suing you, the burden of proof is on them to demonstrate that you and not an electrical problem inherent in the rental unit caused a grease fire. Whoever came to investigate (I assume you called 911) would have been able to tell where the fire originated. You probably have the right to view that report. If the fire WAS electrical in origin, and not due to your negligence, then it is you who should be suing them. For a lot.
  3. get a report from the fire Marshall or fire chief and if it was a electric fire sue the landlord for med bills and lost wages if it was a grease fire you need a lawyer call the lawyer referral council in northern KY and Ohio i hope this helps kitchen fires are horrid
  4. If it wasn't on fire then why did you throw water on it? Either way you all made a mistake unless you can prove that the stove was in some sort of defective state and you can document that you asked the LL to fix it and he didn't....Don't throw water on a grease fire....Don't throw water on an electrical device....The LL can't tell you to leave in a moments notice....Most evictions give you 30 days to vacate...
